The Tax Court has released the decision of Miller J in Kossow v R, 2012 TCC 325. Ms Kossow purported to make a charitable donation through the Ideas/Berkshire donation program. The CRA disallowed all of the credits she claimed for her “gifts”, including those claimed for the cash she paid. The Tax Court has dismissed the taxpayer’s appeal.

John, great to see that you covered this case. it is interesting that almost no one else, including the media, thought that this decision of the TCC should be covered. In total Canadian and provincial governments have lost 3 billion in tax revenue from these type of schemes. One would think that CRA`s success in dealing with this type of scheme would get a little bit of coverage. Mark
The Toronto Star, the Globe and the CBC all ran stories a few years back on programs like Berkshire. But I agree with you that the coverage hasn’t been consistent or persistent.
